"Mecalac Drivers' Video Contest" Competition Rules


Article 1: Organising company

MECALAC FRANCE RCS Annecy 74 B 112 with its head office at Parc des Glaisins - 2 avenue du Pré de Challes F-74942 Annecy-le-Vieux cedex, is organising a free contest with no purchase necessary from

20 March 2017 12.00pm to 6 April 2017 11.59pm

The competition is entitled "Mecalac Drivers' Video Contest". It can be accessed via the following page: http://www.mecalac.com/en/video-contest-my-mecalac-and-me.html


Article 2 : Participation conditions

2.1 This contest is open to any person, whether a customer of MECALAC FRANCE or not, wishing to register free of charge through the web page: http://www.mecalac.com/en/video-contest-my-mecalac-and-me.html

The company reserves the right to carry out all the necessary checks on the identity and postal and/or email address of participants.

2.2 Excluded from participating in this Contest or benefiting from any prizes, whether directly or indirectly, are all staff of the Company and Partners, including their family and spouses (through marriage, civil solidarity pact or marital relationship, whether recognised or not), and underage persons.

2.3 Persons who have not provided evidence of their full contact details and identity or who have provided inaccurate or false details shall be disqualified, as shall all persons who refuse to allow the collection, recording and use of personal information about them that is strictly necessary for the contest's administrative requirements.

2.4 Participation in the Contest implies full and unconditional acceptance of these rules on the part of each participant. Non-compliance with the rules shall result in automatic cancellation of the participation and of the award of any potential prizes.

2.5 Participation in the Video Contest implies permission for the MECALAC France company to use and distribute videos and photographs of participants taken as part of this Contest, free of charge and not exclusively, and to use these videos and photographs for commercial or promotional purposes, and this for a period of ten years, on any media type and in any country.


Article 3: Method of participation

The Contest proceeds as follows; contestants must:

1. Make a video of a maximum of 30 seconds on the theme of "My Mecalac & Me"

2. Log in to the following address to access the contest http://www.mecalac.com/en/video-contest-my-mecalac-and-me.html

3. Click on "register"

4. Complete the entry form

5. Upload the video

6. Agree to abide by all the safety regulations appropriate for their occupation when filming the video made for this contest (wearing personal protective equipment, following the machine operating instructions, etc.)

7. Study the contest rules and check the box to confirm acceptance of them.

·  The contest shall run from 20 March 2017 12.00pm to 6 April 2017 11.59p.m

·  The participant may submit one video via the contest web page.

·  Mecalac France reserves the right of moderation. Any video that does not respect the theme, or that is deemed non compliant, ineligible, or to be putting the driver or his/her environment in danger, shall be automatically rejected.

·  By participating in the "Mecalac Drivers' Video Contest", the participant irrevocably grants and surrenders, without any financial or material compensation and without any time limit, all reproduction, use and publication rights for all videos submitted throughout the duration of the contest.

·  Any video that has been published previously on another medium or already submitted to Mecalac France, shall not be considered.

·  The contest is accessible via the Internet 24 hours a day at: http://www.mecalac.com/en/video-contest-my-mecalac-and-me.html


Article 4: Selection of winners

The jury (members of the Mecalac France company) will select the five finalists' videos. The five videos shall be ranked as follows:

·  One Facebook grand prize winner: the five finalists' videos will be published on Friday, 07 April on the Mecalac Facebook page https://www.facebook.com/mecalac.group. The video that has received the most "likes" on Friday, 14 April will determine the Facebook grand prize winner (anyone who has a Facebook account can "like" one or more of the finalists' videos). The winner will receive a VIP invitation to MECALAC FRANCE in Annecy-le-Vieux (74). See details Article 5: Prizes

·  One Mecalac Jury grand prize winner: on Friday, 14 April, the Jury (members of Mecalac France) will select one winning video from all those submitted throughout the duration of the contest. The winner will receive a VIP trip to MECALAC France in Annecy-le-Vieux (74). See details Article 5: Prizes

·  The other three winners shall be decided by the Jury (members of Mecalac), which will select the videos coming in 3rd, 4th and 5th place from all the videos submitted throughout the duration of the contest.

The winners will be designated after verification of their eligibility to win the relevant prize. The designated participants will be contacted by the Organiser via email. If the participant does not come forward within a month of receiving this email, he/she will be considered as having forfeited the prize, and the prize will remain the property of the Organiser.

By accepting the prize, the winner authorises the Organiser to use his/her surname, first name, town and department of residence in any promotional presentation, on the Organiser's website and on any affiliated site or medium, without such use conferring any right or compensation other than the prize won.

Winners must comply with the rules. Should they fail to meet the criteria of these rules, their prizes shall not be awarded to them. Participants authorise all checks to be made regarding their identity, age, address details and the loyalty and sincerity of their participation. For this reason, the Organiser reserves the right to request a copy of the winner's proof of identity before sending the prize. Any false declaration or false statement of identity or address shall result in the participant's immediate disqualification and, if applicable, refund of prizes already sent.


Article 5: Prizes

The Contest offers the following prizes:

*For the two winners (one grand prize winner designated by the Mecalac jury + one grand prize winner designated by Facebook users):

One one-night stay for one person in Annecy-le-Vieux (FRANCE) including:

·  Travel from the winner's home to Annecy-le-Vieux

·  One night's accommodation

·  Two meals

·  One VIP invitation to the MWR official launch party on 16 May 2017 at the head office of Mecalac in Annecy-le-Vieux (FRANCE)

Value of prize: €500 including all taxes (excluding travel, which varies according to the winner's place of departure)

*For the three other winners (3rd, 4th and 5th place): one "Mecalac Shop Pack" (subject to sizes available) including:

·  one Mecalac MWR scale model

·  one Mecalac softshell jacket

·  one Mecalac polo shirt

·  one Mecalac cap

Estimated value of prize: €200 including all taxes


Article 6: Award of prizes

Following their participation, in the event of winning as described in this document, the winners shall receive all the information required for the award of prizes via email within 15 days (excluding weekends and public holidays) of the announcement of the winners. Prizes will be sent by post to the winners.

The organiser cannot be held responsible for sending prizes to an incorrect address owing to the negligence of the winner. If the prizes cannot be delivered to the intended recipient for any reason, through no fault of the organiser (if the winner has moved house without updating their address, etc.), they shall remain the property of the organiser.

The prizes cannot be exchanged for another item, or for money, and cannot be refunded, either partially or in full. Participants are informed that sale or exchange of prizes are strictly forbidden.

The stated value of the prize(s) corresponds to the currently charged or estimated public price including all taxes on the date of the drafting of the rules, is given on an indicative basis only and may be subject to adjustment. The Organising Company cannot be held responsible for any incident or accident that may occur when using the prizes. All product brands or names referred to are the registered trademarks of their respective owners.


Article 7: Contest with no obligation to purchase

Refund of connection costs incurred for participating in the Contest will be made on the basis of a maximum of three minutes of connection, based on the cost of a local call at the Orange/France Telecom rate in force at the time of drafting these rules (i.e. 0.16 euros per minute).

Participants who do not pay connection costs based on the volume of their communications ("unlimited" subscription holders, cable and ADSL users, etc.) cannot obtain a refund.

Reimbursement will be made on written request to the following address: MECALAC France - Parc des Glaisins - 2 avenue du Pré de Challes F-74942 Annecy-le-Vieux cedex.

Participants must legibly state their surname, first name and full address, and include with their request their bank or post office account details and a photocopy of the relevant invoice, with the dates and times of connection clearly underlined.

Reimbursement of the costs of a claim for reimbursement shall be made based on a simple letter weighing less than 20 grams sent using the economy rate.


Article 8 : Limitation of liability

Participation in the "Mecalac Drivers' Video Contest" implies knowledge and acceptance of the characteristics and limits of the Internet, particularly concerning its technical performance, response times for consulting, querying or transferring information, risks of interruption, and more generally, the risks inherent in connection and transmission via the Internet, the absence of protection of certain data against any misappropriation, and risks of contamination by any viruses circulating on the network. As a consequence, the Organising Company cannot under any circumstances be held responsible for the following (this list is not exhaustive):

1. transmission and/or receiving of any data and/or information over the Internet;

2. any dysfunction of the Internet network preventing the smooth operation/functioning of the Contest;

3. failure of any receiving equipment or communication lines;

4. loss of any paper-based or electronic mail and, more generally, loss of any data;

5. delivery problems;

6. the functioning of any software;

7. the consequences of any virus, computer bug, abnormality or technical defect;

8. any damage caused to a Participant's computer;

9. any technical failure of hardware or software of any type that prevents or limits the possibility of participating in the Contest or causes damage to a Participant's computer system;

10. the malfunctioning of the prizes distributed as part of the contest, and any direct and/or indirect damage that they might cause.

It should be noted that the Organising Company cannot be held responsible for any direct or indirect damage stemming from an interruption, or any malfunction of any kind, for any reason, or for any direct damage resulting in any way from a connection to the site developed as part of this contest. It is the responsibility of each Participant to take all appropriate measures to protect their own data and/or software stored on their computing equipment against any loss or damage. The connection of any person to the address: http://www.mecalac.com/en/video-contest-my-mecalac-and-me.html and the participation of the Participants in the Contest are entirely their own responsibility. The Organising Company may cancel all or part of the "Mecalac Drivers' Video Contest" if it appears that frauds of any kind have been perpetrated, in particular computer fraud or regarding the determination of the winners. In this case, it reserves the right not to award the prizes to the fraudsters and/or to commence legal proceedings against the fraud perpetrators before the competent courts. It will not, however, incur any liability with regard to the Participants for any frauds committed. In particular, it will be considered as fraud for a Participant to use one or more fictitious names or names borrowed from one or more third persons, as each Participant must participate in the Contest using his/her own unique name. Any fraud will lead to the disqualification of the Participant.

The contest is not managed or sponsored by Facebook. Facebook cannot, therefore, in any way be held liable for any dispute linked to the contest. Any questions, comments or complaints about the Contest should be addressed to the contest organisers and not to Facebook. All submitted content is subject to moderation. The organising company is allowed to accept, refuse or delete, on a wholly discretionary basis, any content including any already uploaded, without having to give reasons.

The organiser reserves the right, for any reason whatsoever, to cancel, postpone, suspend or extend the contest or to change the terms of these rules in compliance with the latter. If, as a result of an event beyond its control, it is forced to implement that right, it shall not be held liable.

The organiser reserves the right to permanently exclude from its various contests any person who might harm the smooth operation of the contest through fraudulent behaviour. Moreover, sponsorship of fictitious people shall result in the immediate disqualification of the participant. In addition, any attempt to use the contest outside the unaltered interface set up on the site shall be considered as attempted fraud. Furthermore, decompilation of the contest, use of personal script or any other method of circumventing the purpose of the contest as provided for in the present rules shall also be regarded as attempted fraud and shall result in the immediate disqualification of the participant without recourse.


Article 9: Filing of the rules

As of the date of its implementation, this Contest is subjected to these rules. The rules are available free of charge to any person who requests them from the Contest Organiser at the following address: MECALAC France - Parc des Glaisins - 2 avenue du Pré de Challes F-74942 Annecy-le-Vieux cedex. Stamps used for the written request for a copy of the rules will be refunded at the slow post rate on request.


Article 10: Personal data

Participants are reminded that, in order to participate in the Contest, they are required to provide certain personal information (name, address, etc.). This information is registered and saved in a computer file and is required in order to take their participation into account, to determine the winners and to allocate and award the prizes. This information is for the use of the Organiser, and may be sent to its technical service providers and a service provider that dispatches the prizes. By participating in the Contest, the participant may also request to sign up for an information email from the Organiser. The data thus collected can be used for legal purposes. Pursuant to French Law No. 78-17 of 6 January 1978 relating to Information Technology, computer files and civil liberties, participants have rights to access, rectify and delete any information concerning them. To exercise these rights, participants should write to the following address: MECALAC France - Parc des Glaisins - 2 avenue du Pré de Challes F-74942 Annecy-le-Vieux cedex.

Article 11: Disputes

The present rules are subject to French law. To be taken into consideration, any disputes relating to the Contest must be sent in written form to the following address: Marketing Department - MECALAC France - Parc des Glaisins - 2 avenue du Pré de Challes F-74942 Annecy-le-Vieux cedex. And this must be no later than ninety (90) days after the deadline for participation in the Contest as indicated in these rules. If there is consistent disagreement on the application or interpretation of these rules, and failing amicable agreement, any dispute shall be submitted to the eligible court, which has exclusive jurisdiction.
